1. Acceptance of Terms
By using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our App.
2. Description of Service
Our App provides a service that allows you to convert images from one format to another. You upload an image, select the desired output format, and our App processes the image and provides you with the converted file. This service is offered for a one-time payment.
3. Payment and Access
- One-Time Payment: Access to the image conversion service requires a one-time payment, the amount of which will be clearly stated on the App.
- Payment Processing: Payments are processed securely through Stripe, a third-party payment processor. You will be directed to Stripe's platform to complete your payment.
- Access Granted Upon Payment: Upon successful payment confirmation from Stripe, you will be granted access to use the image conversion service.
4. User Conduct and Acceptable Use
You agree to use the App in a responsible and lawful manner. You must not:
- Upload Illegal or Harmful Content: Upload images that are illegal, infringing, defamatory, obscene, or otherwise harmful or objectionable.
- Violate Intellectual Property Rights: Upload images that infringe upon the intellectual property rights of others (e.g., copyright, trademarks). You are solely responsible for ensuring you have the necessary rights to upload and convert the images you use.
- Misuse the App: Use the App in a way that could damage, disable, overburden, or impair our servers or networks, or interfere with any other user's use of the App.
- Attempt Unauthorized Access: Attempt to gain unauthorized access to the App, our systems, or user data.
- Use for Commercial Purposes Without Authorization: Use the App for commercial purposes beyond the intended image conversion service without our explicit written consent.
5. Intellectual Property
- Your Images: You retain ownership of the images you upload to the App. We do not claim any ownership of your images.
- Our App: The App, including its software, design, graphics, and content (excluding user uploaded images), is owned by us and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, and revocable license to use the App for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of our App without our prior written consent.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We make no guarantees regarding the quality or accuracy of image conversions. The output quality may vary depending on the input image and the chosen output format.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR APP; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT; OR (F) FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS EXCEED THE AMOUNT YOU PAID TO USE THE APP (I.E., THE ONE-TIME PAYMENT).
8. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you upload or transmit through the App.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify or update these Terms at any time. We will post any changes on this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
